Terms & Conditions

Please read these Terms carefully before using Darade. These Terms form a binding agreement between you and Darade.

1. Introduction

Welcome to Darade ("Platform", "we", "us", or "our"), operated by Darade. These Terms & Conditions ("Terms") govern your access to and use of our website, mobile experiences, membership services, resort listings, booking tools, events, reviews, and related support services (collectively, the "Services").

By creating an account, purchasing a membership, making a booking, or otherwise using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

2. Eligibility & Account Registration

You must be at least 18 years old and capable of entering into a legally binding contract to register for an account or complete a booking. You agree to provide accurate, current, and complete information during registration and to keep your profile updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at support@holidayclub.com if you suspect unauthorized access.

We may suspend or terminate accounts that contain false information, violate these Terms, or pose a security or fraud risk.

3. Membership Plans & Benefits

Membership tiers, pricing, benefits, and availability are described on the Membership page and may change from time to time. Benefits may include access to exclusive resort inventory, member pricing, priority support, events, and promotional offers as stated for each plan.

Membership fees are billed as displayed at checkout unless otherwise stated. Memberships are personal to the registered member and are generally non-transferable unless we expressly approve a transfer in writing.

We may modify membership benefits with reasonable notice where required by law. Continued use of the Services after changes take effect constitutes acceptance of updated membership terms.

4. Resort Listings & Bookings

Resort descriptions, photos, amenities, ratings, and availability are provided for information purposes. While we strive for accuracy, some details are supplied by third-party resort partners and may change without notice.

A booking is confirmed only after successful payment and issuance of a booking confirmation (by email and/or in your dashboard). Prices, taxes, fees, and currency conversions shown at checkout are binding for that transaction unless an obvious error occurs.

You agree to provide valid guest details, contact information, and payment authorization. You are responsible for ensuring travel documents, visas, health requirements, and local regulations are satisfied before travel.

5. Payments, Invoices & Taxes

Payments may be processed through approved payment gateways. By submitting payment details, you authorize us and our payment partners to charge the applicable amount for memberships, bookings, add-ons, or other purchases.

Invoices and receipts are available in your account dashboard where applicable. You are responsible for any applicable taxes, levies, or bank charges unless stated otherwise at checkout.

If a payment fails, is reversed, or is disputed without valid cause, we may cancel the related booking or membership and restrict account access until the matter is resolved.

6. Cancellations, Modifications & Refunds

Cancellation and modification rules depend on the product purchased. Resort bookings may be subject to partner-specific cancellation windows, no-show policies, and partial or non-refundable charges as disclosed before confirmation.

Eligible cancellations may be initiated from Dashboard → My Bookings where the option is available. For changes not supported online, contact support with your booking reference.

Membership refunds, if any, are handled according to the plan terms shown at purchase. We may offer credits instead of cash refunds where permitted by law or partner policy.

Force majeure events (natural disasters, government restrictions, strikes, pandemics, etc.) may affect travel and refund eligibility. We will work with resort partners to find reasonable solutions but cannot guarantee outcomes beyond contractual obligations.

7. Reviews, Content & Community Conduct

Members may submit reviews after eligible stays. Reviews must be honest, relevant, and free of offensive, defamatory, or misleading content. We may remove reviews that violate our policies or applicable law.

By submitting content (reviews, photos, messages, inquiries), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content in connection with the Services.

You agree not to misuse the Platform, including attempting unauthorized access, scraping data, posting spam, harassing staff or members, or interfering with system integrity.

8. Third-Party Services & Links

Resorts, payment processors, analytics providers, authentication services (such as Google Sign-In), and other third parties may integrate with the Platform. Their terms and privacy practices apply to those interactions.

We are not responsible for third-party websites, services, or acts/omissions of resort partners beyond our contractual role as a booking and membership platform, except where liability cannot be excluded under applicable law.

9. Intellectual Property

All Platform content—including branding, design, text, software, logos, and curated resort materials—is owned by or licensed to Darade and protected by intellectual property laws.

You may not copy, modify, distribute, reverse engineer, or create derivative works from the Services except as permitted by law or with our prior written consent.

10. Disclaimers

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee uninterrupted access, error-free operation, or that every resort experience will meet personal expectations. Travel involves inherent risks that remain your responsibility.

11. Limitation of Liability

To the maximum extent permitted by law, Darade and its officers, employees, and partners shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or travel disruption.

Our total liability for any claim relating to the Services shall not exceed the amount you paid to us for the specific booking or membership giving rise to the claim during the twelve (12) months before the event, unless a higher limit is required by law.

12. Indemnification

You agree to indemnify and hold harmless Darade, its affiliates, and personnel from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Services, violation of these Terms, or infringement of third-party rights.

13. Termination

You may stop using the Services at any time. We may suspend or terminate access for violations of these Terms, fraud prevention, legal compliance, or extended inactivity where permitted.

Sections that by nature should survive termination—including payment obligations, disclaimers, liability limits, and dispute provisions—will remain in effect.

14. Governing Law & Disputes

These Terms are governed by the laws of India, without regard to conflict-of-law principles, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

Disputes should first be raised with our support team at support@holidayclub.com. If unresolved, disputes may be submitted to the competent courts or arbitration forum as required by applicable law.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated effective date. Continued use after changes constitutes acceptance.
